Terms of Service for Students

Before you can request, revise or accept any lesson on TutorHi, you must accept the following terms and conditions.
General
1. Essay Writing and Other Prohibited Services
a) It is strictly forbidden to solicit tutors to solely write and/or purchase essays, assignments, projects or any other academic tasks.
b) This type of academic misconduct is illegal in certain countries and territories, and if conducted on our platform by you and/or your tutor, you agree that TutorHi is not liable for your engagement in these activities to any degree.
2. Platform Liability
a) You agree that in the event that you commit or engage in any illicit activities using our platform, TutorHi will not be liable nor accountable for any of those illicit activities in any way or to any extent.
b) You agree that in the event that you commit or engage in any illicit activities using our platform, all liabilities and accountabilities for those illicit activities will fully rest on you.
c) You agree that TutorHi solely provides the means to connect with students and tutors, and that besides those explicitly stated in the Terms of Service here, TutorHi will not be held accountable nor liable, in any way, for any damages or undesired consequences that may arise from the booking, attendance and/or payment of the lesson.
3. Achievements Liability
a) You agree that all "Achievements" on our platform are provided for informational purposes only. We do not guarantee the accuracy, completeness, or authenticity of any Achievement. Our Achievement review process is intended to provide some evidence that the tutor's claims may be legitimate, but we make no representation or warranty that this is the case.
b) By using our platform, you acknowledge that Achievements are not a guarantee of the tutors's credentials, qualifications, or reliability.
c) We expressly disclaim any liability for any damages or losses that may arise from your reliance on any Achievement. You assume all risks associated with your use of our platform and any Achievements provided by us.
4. Non-poaching
a) You understand that it is prohibited to directly or indirectly induce or attempt to induce any tutor, student or user on the platform to join a competing and/or similar platform.
b) You understand that it is prohibited to directly or indirectly induce or attempt to induce any tutor, student or user on the platform to join another platform in the education industry.
c) By using our platform, you agree that in the event you breach clauses 4a and/or 4b, TutorHi's success as a business is unfairly and intentionally damaged.
d) By using our platform, you agree to indemnify TutorHi for any loss or damage suffered or incurred arising out of your breach of clause 4a and/or 4b.
5. Mobile App, Web App and Website Communications
a) While the TutorHi team aims to make TutorHi a high quality and reliable tutoring platform, you understand and agree that positive terms such as 'high quality', 'excellent', and other similar terms used on the mobile app, web app, website and any other marketing mediums/channels are solely for marketing purposes and may not necessarily reflect the actual quality of the services provided.
b) You agree that TutorHi will not be held liable for any reliance placed on such terms by users of the mobile app, web app and/or website. You also understand and acknowledge that the use of such terms does not constitute a guarantee or warranty of the quality of the services offered through the mobile app, web app and/or website.
6. Information Usage
a) By using our services and providing any information, text, image, video, or other content, you grant TutorHi a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of marketing TutorHi's services. This includes but is not limited to promotional materials, advertisements, social media campaigns, website content, and other marketing initiatives. This license extends to all forms of media, both online and offline.
Lessons and Payments
7. Payment
a) You agree that your primary payment method be charged the amount presented to you on confirmation of lesson acceptance. TutorHi is not responsible for any disputes arising from the payment amount, nor any claims of accidental or unintentional payments made.
b) In the event where you believe you are a victim of financial scam, fraud or theft, you are eligible to file a formal complaint. TutorHi will investigate the matter, along with any evidence you may have: if ruled in your favor, you will receive a full refund, less any processing fees.
8. Cancellation Policy
a) You may cancel a confirmed lesson any time up to an hour before the agreed lesson start date and time. In the event that you do decide to cancel a lesson, you are eligible for a partial refund. The refund amount depends on the proximity of the cancellation time to the lesson start date. Upon pressing the 'Cancel' button in the Lesson screen, you will be presented with the amount of your refund should you proceed to cancel. In accepting this agreement, you agree that you will be receiving a partial refund and that TutorHi is not liable for any potential disputes arising from the refund amount
b) You agree that the tutor may cancel a confirmed lesson any time up to an hour before the agreed lesson start date and time. In the event that they do decide to cancel the lesson, you are entitled to a full refund, less any processing fees, and in rare cases, currency exchange and/or service fees as well.
9. Poor Quality of Service
a) You are eligible to receive protection against tutor misconduct. In the event that you find a tutor to be significantly misrepresenting their level of skill and/or service, you are able to submit a formal complaint, along with any evidence you may have. TutorHi will do its best to investigate the matter and inform you of the outcome our investigation. If the tutor is deemed to be fraudulent or significantly misrepresenting their level of skill and/or service, we will offer you a full refund, less any processing fees, and take appropriate action against the tutor. Furthermore, we may protect you from any negative reviews the tutor may leave. By accepting this agreement, you agree that TutorHi's decision is final and that TutorHi is not liable for any dispute or disagreement you may have with its final decision.
b) You have 48 hours after your lesson officially ends (the lesson start date & time + the duration), to submit a format complaint. Submitting a complaint any time after that will not be possible.
