Terms of Service for Tutor

Before you can revise or accept any lesson on TutorHi, you must accept the following terms and conditions.
General
1. Relationship with TutorHi
a) By using the TutorHi platform, you acknowledge and agree that TutorHi does not employ or contract any tutors, and that TutorHi merely provides a platform to connect students and tutors for the purpose of tutoring services.
b) You understand and agree that there is no employment or independent contractor relationship between you and TutorHi.
c) You understand and agree that TutorHi's role is limited to facilitating the connection between students and tutors, and resolving disputes between them, if necessary. Any interaction between a student and tutor is solely between those parties, and TutorHi is not a party to such interaction.
d) You also acknowledge and agree that you are not entitled to any benefits that may be offered to formal employees of our company, including but not limited to health insurance, paid time off, and retirement benefits
2. Essay Writing and Other Prohibited Services
a) Although you can definitely help students with their essay writing, assignments, etc, you agree that it is strictly forbidden to solely write and/or sell essays, assignments, projects or any academic tasks to students.
b) This type of academic misconduct is illegal in certain countries and territories, and if conducted on our platform by you and/or your student, you agree that TutorHi is not liable for your engagement in these activities to any degree.
3. Platform Liability
a) You agree that in the event that you commit or engage in any illicit activities using our platform, TutorHi will not be liable nor accountable for any of those illicit activities in any way or to any extent.
b) You agree that in the event that you commit or engage in any illicit activities using our platform, all liabilities and accountabilities for those illicit activities will fully rest on you.
c) You agree that TutorHi solely provides the means to connect with students and tutors and that besides those explicitly stated in the Terms of Service here, TutorHi will not be held accountable nor liable, in any way, for any damages or undesired consequences that may arise from the booking, attendance and/or payment of the lesson in any way.
4. Non-poaching
a) You understand that it is prohibited to directly or indirectly induce or attempt to induce any tutor, student or user on the platform to join a competing and/or similar platform.
b) You understand that it is prohibited to directly or indirectly induce or attempt to induce any tutor, student or user on the platform to join another platform in the education industry.
c) By using our platform, you agree that in the event you breach clause 4a and/or 4b, TutorHi's success as a business is unfairly and intentionally damaged.
d) By using our platform, you agree to indemnify TutorHi for any loss or damage suffered or incurred arising out of your breach of clauses 4a and/or 4b.
5. Mobile App, Web App and Website Communications
a) While the TutorHi team aims to make TutorHi a high quality and reliable tutoring platform, you understand and agree that positive terms such as 'high quality', 'excellent', and other similar terms used on the mobile app, web app, website and any other marketing mediums/channels are solely for marketing purposes and may not necessarily reflect the actual quality of the services provided.
b) You agree that TutorHi will not be held liable for any reliance placed on such terms by users of the mobile app, web app and/or website. You also understand and acknowledge that the use of such terms does not constitute a guarantee or warranty of the quality of the services offered through the mobile app, web app and/or website.
6. Information Usage
a) By using our services and providing any information, text, image, video, or other content, you grant TutorHi a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of marketing TutorHi's services. This includes but is not limited to promotional materials, advertisements, social media campaigns, website content, and other marketing initiatives. This license extends to all forms of media, both online and offline.
Lessons and Payments
7. Payment
a) You agree that you will receive payment of an amount equal to the lesson price, less any service and processing fees. You also agree that you will receive these funds in the payout method you specified in the 'Payments' screens, unless TutorHi decides otherwise.
b) You understand and agree that the lesson fee amounts and/or percentages advertised on TutorHi's marketing mediums, including the website, advertisements, and other promotional materials, is provided as an indication and may not reflect the actual fee charged to users. The actual fee may vary based on several factors, including but not limited to monthly payout charges, cross-border fees, currency conversion rates, and any other applicable fees or charges imposed by our payment processor.
8. Payout
a) You agree to be paid out on a weekly basis for lessons you've successfully conducted; a successfully conducted lesson is one that has not received any complaints from all parties for a period of 48 hours after the lesson officially ends (the lesson start date & time + lesson duration). Your payout may be withheld if you have not completely set up your payout details. For more information, refer to the article on how payout works.
9. Cancellation Policy
a) You may cancel a confirmed lesson any time up to an hour before the agreed lesson start date and time. In the event that you do decide to cancel a lesson, the full amount of the lesson price, less any processing fees, will be refunded to the student. In accepting this agreement, you agree that upon your initiation of any lesson cancellation, the student will receive the refund amount stated above and that TutorHi is not liable for any disputes regarding the refund amount.
b) You agree that the student may cancel a confirmed lesson any time up to an hour before the agreed lesson start date and time. In the event that they do decide to cancel the lesson, they are entitled to a partial refund, with the refund amount depending on the proximity of the cancellation date & time to the lesson start date & time.
10. Poor Quality of Lesson
a) You are eligible to receive protection against student misconduct. In the event that you find a student to be malicious, disrespectful, or acting in a manner that does not reflect a desire to learn, you are able to submit a formal complaint, along with any evidence you may have. TutorHi will do its best to investigate the matter and inform you of the outcome our investigation. If the outcome is ruled in your favor, we may protect you from any negative reviews the student may leave, as well as take appropriate action against the student to prevent them from further lowering the quality of service on TutorHi. By accepting this agreement, you agree that TutorHi's decision is final and that TutorHi is not liable for any dispute or disagreement you may have with its final decision.
b) You have 48 hours after your lesson officially ends (the lesson start date & time + the duration), to submit a format complaint. Submitting a complaint any time after that will not be possible.
